Morgan was involved in a truck accident in Newark in 2014, when Kevin Roper struck the limousine he was riding in. Roper, who was working for Wal-Mart, was charged with death by auto and assault by auto charges in a state court. He reportedly had not slept for 24 hours prior to the crash, in violation of state law.

Morgan suffered critical injuries and spent several months in rehabilitation and is still recovering. Four other people were injured in the accident, and one person, James McNair, was killed.

In response to a lawsuit brought on by Morgan, Wal-Mart said that the passengers’ injuries were caused by their “failure to properly wear an appropriate available seatbelt restraint device.”

Morgan’s attorneys called the claims “disingenuous” and they are seeking a jury trial, and punitive and compensatory damages.
